These Terms of Service (“Terms”) govern your access to and use of the website located at selectautorentals.com, our related landing pages, booking forms, content, features, tools, products, and services (collectively, the “Services”), operated by Select Auto Rentals (“Select Auto Rentals,” “we,” “us,” or “our”).
By accessing or using the Services, including by submitting any form, creating an account, or completing a reservation, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Services.
These Terms are a legal agreement between you and Select Auto Rentals. Please read them carefully.
1. Eligibility & Use of the Services
1.1 Eligibility
You may use the Services only if you:
* Are at least 18 years of age (or the age of majority in your jurisdiction, if higher);
* Have the legal capacity to enter into a binding contract; and
* Will use the Services in compliance with these Terms and all applicable laws and regulations.
Additional age, license, and eligibility requirements may apply to vehicle rentals and will be described in your rental agreement or confirmation.
1.2 Use of the Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not use the Services:
* In any way that violates any applicable federal, state, local, or international law or regulation;
* To impersonate any person or entity or misrepresent your identity;
* To interfere with or attempt to interfere with the proper functioning of the Services; or
* In a way that could damage, disable, overburden, or impair the Services or our systems.
2. Accounts & Security
2.1 Account Creation
Certain features of the Services may require you to create an account. When you create an account, you agree to:
* Provide accurate, current, and complete information;
* Maintain and promptly update your information to keep it accurate and complete;
* Maintain the confidentiality of your login credentials; and
* Accept responsibility for all activities that occur under your account.
2.2 Security
You are responsible for maintaining the security of your account and for promptly notifying us if you suspect any unauthorized access or use. We are not liable for any loss or damage arising from your failure to safeguard your account credentials.
3. Reservations, Rentals & Transactions
3.1 Reservation Requests
Using the Services, you may submit reservation requests for vehicles and related services. All reservations are subject to availability and acceptance by us. We may accept, reject, or cancel any request at our discretion.
3.2 Rental Agreements
The actual use of any vehicle will be governed by additional documents and terms, including but not limited to a rental agreement, policies on deposits, insurance, mileage, fuel, damage, and other conditions. In the event of a conflict between these Terms and a signed rental agreement relating specifically to your rental, the rental agreement will control for the vehicle rental.
3.3 Pricing & Fees
Prices and fees are displayed or communicated through the Services or directly by us and may be changed at any time prior to confirmation. Taxes, fees, deposits, and other charges may apply. You are responsible for all applicable taxes, fees, and charges arising out of your use of the Services and any rentals.
3.4 Payments
Payments may be processed by third-party payment processors on our behalf. By submitting payment information, you authorize us and our payment processors to charge the specified amounts. You represent and warrant that you are authorized to use the payment method you provide.
3.5 Cancellations & No-Shows
Cancellation policies, no-show policies, and associated fees will be disclosed at the time of booking or in your rental agreement. By completing a reservation, you agree to those policies.
4. Third-Party Services & Integrations
4.1 Service Providers
We use third-party service providers to host and operate parts of the Services, process payments, manage reservations, send communications (including SMS), and analyze performance. These may include, for example, web hosting platforms (such as GoHighLevel), reservation software, payment processors, and communications providers (such as Twilio).
4.2 Third-Party Websites
The Services may contain links to third-party websites or resources. We are not responsible for the content, products, or services on or available from those websites or resources. Your use of these third-party sites is at your own risk and subject to their terms and privacy policies.
5. SMS/Text Messaging Terms
By providing your mobile phone number through the Services and opting to receive SMS/text messages, you agree to the following SMS/Text Messaging Terms:
5.1 Consent to Receive Messages
You consent to receive SMS/text messages from Select Auto Rentals at the mobile number you provide, including:
* Reservation confirmations, reminders, updates, and changes;
* Vehicle pickup and return information;
* Account notifications, billing, and security alerts; and
* Promotional and marketing communications, where allowed by law.
Your consent to receive text messages is not a condition of renting a vehicle or making a purchase, where prohibited by applicable law.
5.2 Message Frequency & Costs
Message frequency may vary based on your interactions with us (for example, the number of reservations you make or your responses to our messages).
Message and data rates may apply according to your mobile carrier plan. You are responsible for any charges imposed by your carrier.
5.3 Opt-Out Instructions
You may opt out of receiving marketing and promotional SMS text messages at any time by replying “STOP” to any message we send. After we receive your STOP request, we will send you a confirmation message and stop sending promotional text messages to that number.
We may still send you non-promotional, transactional SMS messages where permitted by law (for example, messages regarding an active reservation, billing, or security alerts).
5.4 Help Instructions
If you need assistance related to our text messaging program, reply “HELP” to any of our messages or contact us at [[email protected]](mailto:[email protected]).
5.5 Carriers & Delivery
SMS message delivery may be subject to the capabilities and coverage of your mobile carrier and network. Select Auto Rentals and its service providers, including Twilio, are not liable for any delays in or failures of SMS message delivery.
5.6 Use of Third-Party Providers (Twilio)
We use third-party providers, including Twilio, to send and receive SMS messages. These providers act as our service providers and process your information on our behalf in accordance with our Privacy Policy and applicable law.
5.7 Changes to SMS Terms
We may update these SMS/Text Messaging Terms from time to time. Any changes will be effective when posted as part of these Terms or otherwise communicated to you, where required by law.
6. User Content & Conduct
6.1 User Content
You may be able to submit or upload content through the Services (for example, inquiries, reviews, feedback, or other communications). You represent and warrant that:
* You own or have the necessary rights to the content you submit; and
* Your content does not violate any third-party rights or any applicable laws or regulations.
By submitting content, you grant Select Auto Rentals a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, display, distribute, and otherwise exploit such content in connection with the Services and our business, subject to applicable law and our Privacy Policy.
6.2 Prohibited Conduct
You agree not to:
* Use the Services in a manner that is unlawful, fraudulent, or otherwise harmful;
* Send any unsolicited or unauthorized advertising, promotional materials, or spam;
* Introduce viruses, malware, or other malicious code;
* Attempt to gain unauthorized access to the Services, accounts, or systems; or
* Interfere with or disrupt the integrity or performance of the Services.
We reserve the right to suspend or terminate your access to the Services for any violation of these Terms.
7. Intellectual Property
7.1 Ownership
The Services, including all text, graphics, images, logos, trademarks, service marks, videos, software, and other content, are owned by Select Auto Rentals or our licensors and are protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use (or for your internal business use, where applicable) solely in connection with renting vehicles or using services from Select Auto Rentals.
You may not copy, modify, distribute, sell, or lease any part of the Services or any content therein, nor may you reverse engineer or attempt to extract the source code of any software that is part of the Services, except to the extent laws prohibit these restrictions or you have our written permission.
8. Disclaimers
8.1 No Warranty
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SELECT AUTO RENTALS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
* The Services will be uninterrupted, timely, secure, or error-free;
* Any information obtained through the Services will be accurate or reliable; or
* Any defects or errors will be corrected.
8.2 No Guarantee of Availability
We make no representations or warranties about the availability or suitability of specific vehicles or services. Vehicle availability is subject to change, and we may substitute comparable vehicles or decline reservations at our discretion, subject to applicable law and your rental agreement.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SELECT AUTO RENTALS, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:
* YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES;
* ANY CONTENT, INFORMATION, OR SERVICES OBTAINED THROUGH THE SERVICES; OR
* ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR THROUGH THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO US FOR THE RELEVANT TRANSACTION GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS (US $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above exclusions or limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Select Auto Rentals, its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
* Your use of, or activities in connection with, the Services;
* Your violation of these Terms or any applicable law; or
* Any content you submit or transmit through the Services.
We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of these claims.
11. Governing Law & Dispute Resolution
11.1 Governing Law
These Terms and any dispute arising out of or relating to them or the Services will be governed by and construed in accordance with the laws of the State of Missouri, without giving effect to any conflict of law principles.
11.2 Informal Resolution

11.3 Venue
Subject to any mandatory provisions of applicable law, you agree that any legal action or proceeding arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Missouri, and you consent to the personal jurisdiction of such courts.
12. Changes to the Services or Terms
12.1 Changes to the Services
We may modify, suspend, or discontinue all or any part of the Services at any time, with or without notice, subject to applicable law.
12.2 Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page and may provide additional notice where required by law. Your continued use of the Services after any changes take effect constitutes your acceptance of the updated Terms.
If you do not agree to the revised Terms, you must stop using the Services.
13. Miscellaneous
13.1 Entire Agreement
These Terms, together with our Privacy Policy and any additional terms provided at the time of booking or in a rental agreement, constitute the entire agreement between you and Select Auto Rentals regarding your use of the Services.
13.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
13.3 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
13.4 Assignment
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms at any time, including in connection with a merger, acquisition, sale of assets, or by operation of law.
